Insolvency Proceedings

Insolvency proceedings are legally regulated proceedings initiated when a company can no longer meet its payment obligations or is over-indebted. The objective is either to restructure the company or – if this is not possible – to wind it up in an orderly manner and satisfy creditors’ claims.

If a company experiences financial difficulties, insolvency proceedings may be opened. They provide a legal framework to protect creditors’ interests while, where possible, enabling the company to continue operating.

Depending on the circumstances, insolvency proceedings can pursue different objectives. While some companies can be successfully restructured, in other cases the proceedings result in the termination of business activities. Insolvency proceedings therefore do not automatically mean that a company has already ceased operations.

Practical relevance: Information on ongoing or completed insolvency proceedings is relevant to numerous business decisions.

It supports, among other things:

  • credit decisions,
  • creditworthiness and risk analyses,
  • due diligence reviews,
  • supplier and business partner assessments,
  • compliance processes, and
  • ongoing monitoring of company risks.

What matters is not only whether proceedings exist, but also the current proceedings status and the context in which the proceedings occur.
